Terms of Service

1. Who can use FetchFiles

You must be at least 18 years old to use the Service, including the waitlist. When you create an account, you must confirm that you are 18 or older and agree to these Terms and the Privacy Policy. The Service is offered to users in the United States. If you use FetchFiles on behalf of a company or clinic, you represent that you have authority to bind that organization.

The Service is a consumer tool for organizing pet records. It is not a veterinary practice, not a medical device, and not a substitute for professional veterinary advice, diagnosis, or treatment.

2. The Service

FetchFiles lets you:

• join a waitlist to be notified when the mobile app is available;
• store profiles for your pets and records you upload (for example vaccines, prescriptions, and clinic documents);
• invite other FetchFiles users as caregivers with a permission level you choose; and
• create time-limited links so others can view selected records without an account.

By joining the waitlist, you agree we may email you at the address you provide when FetchFiles is available to download. Launch emails will include a way to unsubscribe.

We may change, suspend, or discontinue features. We do not promise that the Service will be uninterrupted or error-free, or that we will store your files forever.

Current product limits include: up to five active pets per account; record attachments limited by file type (images and PDF) and size (currently 50 MB per record file); and share packages limited to 20 items with expirations between 1 hour and 30 days.

3. Accounts

You must provide accurate information and keep your login confidential. You are responsible for activity under your account.

We offer email/password sign-in and Sign in with Apple.

You can sign out in the app. You can delete your account and associated data from Account in the app. We will process deletion subject to legal retention needs and residual copies in backups.

If you use Sign in with Apple’s “Hide My Email,” we will receive Apple’s private relay address, not your personal email. Caregiver invites are matched to the email associated with the invitee’s FetchFiles account.

4. Your content

“User Content” means everything you or people you authorize submit to the Service: waitlist information, pet information, notes, photos, PDFs, scans, caregiver names and emails, share-package contents, and similar material.

You retain ownership of your User Content. You grant Fetch Files LLC a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, display, and make copies of User Content only as needed to operate the Service (including generating previews, signed download links, share pages you create, and sending waitlist notices).

You represent that:

• you have all rights needed to upload the User Content and to grant the license above;
• User Content does not violate law or someone else’s rights (privacy, publicity, copyright, veterinary-record confidentiality rules that apply to you, and similar rights); and
• you will not upload content that is illegal, pornographic, or that you do not have permission to share.

We do not claim ownership of your veterinary documents. We are not a party to your relationship with any veterinarian, groomer, trainer, or sitter.

5. Sharing is your responsibility

Caregiver access. When you invite someone, they may view, add, or edit that pet’s information according to the access level you grant, once they have a FetchFiles account with the invited email. Invites store the person’s name and email on our servers. The current product does not send invitation emails; access starts when they sign up with that email (or if they already have an account). You can revoke access. Revocation is intended to take effect for future use of the Service; we cannot control copies they already downloaded.

Public share links. A share package URL is a secret link. Anyone who has it can view and download the selected records and files until the link expires or you revoke it, without logging in. Do not post share links on public websites or social media if you want them to stay limited to one vet or sitter. If a link is forwarded, leaked, or guessed, those recipients can access the package. We log limited access metadata (for example that the link was opened) for the owner.

You decide what to share. Fetch Files LLC is not responsible for a recipient’s misuse of information you chose to share.

6. Acceptable use

You agree not to:

• break the law or upload malware;
• try to access other users’ data without authorization, probe the Service, or circumvent access controls;
• scrape, overload, or reverse engineer the Service except as allowed by law;
• use the Service to send spam, or to collect others’ emails without permission;
• impersonate others or misrepresent your affiliation;
• use FetchFiles to store or share content involving the sexual exploitation of children, or any content we reasonably consider harmful or illegal;
• resell or provide the Service as a commercial clinic EMR or practice-management system unless we agree in writing.

We may suspend or terminate accounts that violate these Terms, and we may remove waitlist submissions used for abuse.

7. Not veterinary advice; no professional relationship

Information in the Service is supplied by users. FetchFiles does not review records for medical accuracy. Always seek a licensed veterinarian for advice about an animal. Do not delay veterinary care because of something you see or cannot find in the app.

Nothing in the Service creates a veterinarian-client-patient relationship with Fetch Files LLC.

8. Intellectual property

The app, website, branding, UI, and software are owned by Fetch Files LLC or its licensors. You may not copy, modify, or redistribute our software except as allowed by applicable law or an open-source license that applies to a component.

9. Third-party services

The Service uses infrastructure providers (including hosting and database/storage providers) and, if you choose it, Sign in with Apple. Their terms apply to their services. Share links opened in a browser, and URLs you send through Messages or Mail, also involve those third parties.

10. Disclaimers

The Service is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that files will be available without loss, that share links cannot be forwarded, or that the Service is error-free.

Some jurisdictions do not allow certain disclaimers. In those places, disclaimers apply to the fullest extent allowed.

11. Limitation of liability

To the maximum extent permitted by law, Fetch Files LLC and its members, managers, officers, employees, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, or goodwill, arising from the Service or these Terms, even if advised of the possibility.

Our total liability for any claim relating to the Service or these Terms will not exceed the greater of (a) the amounts you paid us for the Service in the 12 months before the claim or (b) USD $50. The Service is currently offered without charge; this cap still applies.

These limitations do not limit liability that cannot be limited under law (for example, certain liability for fraud or personal injury).

12. Indemnity

You will defend and indemnify Fetch Files LLC against claims, damages, and expenses (including reasonable attorneys’ fees) arising from your User Content, your sharing of records or invitee information, or your violation of these Terms or the law — except to the extent caused by our willful misconduct.

13. Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms, if we reasonably believe it is needed to protect the Service or others, or if we discontinue the Service.

After termination, provisions that should survive (including ownership, disclaimers, liability limits, and indemnity) remain in effect. We may delete or restrict access to User Content after account deletion, subject to the Privacy Policy and backups.

14. Changes

We may update these Terms. We will post the updated Terms and change the effective date. If a change is material, we will provide additional notice (for example in the app or by email) where reasonably possible. Continued use after the effective date constitutes acceptance, except where law requires opt-in.

15. Governing law; disputes

These Terms are governed by the laws of the State of Georgia, excluding conflict-of-law rules. Except where prohibited, exclusive venue lies in the state courts located in Fulton County, Georgia, or the United States District Court for the Northern District of Georgia.

Before filing a claim, you agree to contact connect@fetch-files.com and try to resolve the dispute informally for 30 days.

16. Miscellaneous

If a provision is unenforceable, the rest remains in effect. These Terms are the entire agreement for the Service. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Our failure to enforce a provision is not a waiver.
